My niece came with B2 visa and attend public school during her legal stay. Now She wanted to apply for F1 to attend private school. I heard that her study at public shcool is considered violation of the immigration law. Does she have risk of denial when she appliced B2-F1 status change?

- The USCIS may not know her attending public high school. She files I-539 to COS to F-1, with I-20.
