What should I say about Lawyer's mistake(NIW REF)

This is very frustrated that my lawyer made a big mistake when he filed my NIW I-140. He said that I never file it before. Actually I filed it in 2005 and was denied. He already know it and now I got REF and need to explain this problem. How can I explain this to USCIS.Please give me some advices and I really appreciate it.
