置疑律師， 再問 university H1B extension + April 1 industry H1B，

我正辦理大學H1B延期，同時公司在準備我四月1號占CAP H1B 申請。 問題是我延期申請隻能在3月25號提交，在公司3月31號遞交H1B前無法拿到延期reciept，因為預測4月1號當天H1B全部用完。 律師認為

(1) " We must apply for straight H1B, which requires you to depart U.S and come back, because before April 1st, you have GAP".

(2) If we do not apply for straight H1B, you will loose the chance to get H1B, because "If we file without the approval, it is likely
that a remand will be issued on the case and we will need to respond with
proof that the extension was approved."

我請教了pharmacyelite 和 pjiang, 好像他們的分析都不讚公司律師的觀點。大家認為避免上訴(2) 發生的最佳方法是不是如下

(1) In industry H1B petition, include copies of my university H1B extension, including LCA, Offer letter, prevailing wage, actual wage report, I129 forms, such that VO has sufficient information to adjudicate my case.

(2) Even after March 25, 2008, apply premium processing to get H1B extension as early as possible.
