1. ) One thing I don't understand is they were not supposed to accept your EB2 based I485 filing if they didn't agree on the PD carryover unless your EB2 PD date is 01/01/2006.
2. ) I saw one different between you case and my case is your lawyer submitted I485 based on EB2 I140, which looks like a single EB2 case with later PD date.
My lawyer did a smarter thing: she submitted my EB3 I485 with the earlier PD date, then she submitted the EB2 I140 and also a letter stating the connection between 2 cases and the carryover intention so she successfully caught INS's attention.
Just my 2 cents though, FYI.
