need your suggustions for wife's I485 filing

I need your suggestion about my wife's I485 filing.

I have my I485 submitted in June/2007 and currently received EAD and AP. I got married last month while my EB2 PD is not current right now because of the retrogression. The company's lawyer said my wife's I485 can not be filed until my PD becomes current. I am wondering if it is still possible for USCIS to approve my I484 even though my PD is not current. Have you heard any such cases? What is the best way to handle this situation?

Appreciate your input/suggestion.
