Actually, my TN was still good until may next year. and I don;t think my company will apply a H1B for me right now. His lawyer said my EAD replaced my TN, so I already showed my HR and they updated my 1-9. Does that mean I "Used" EAD already???

Sorry to say, unless you may request your HR to remove the updated I-9, you were considered AOS.
