I am H1 now, and want to get H1 visa in Beijing. If reject, I will use AP come back, Does this mean I am not H1, and if I stiil work for the same employer, should I apply EAD and use EAD after I come back? Thanks a lot!
- The rejection of H-1 visa at a consulate does not necessarily invalidate your H-1 status in US even after you have used AP for admission. In such case, an EAD is not a must to work for the employer as indicated on your H-1 approval notice.
