回複：請問我還能重新馬上再申請h1嗎？多謝多謝！！

原因是忘了交ETA9035(被REF後補交， 不過為時過晚)。

現在notice已經送到，拒了我的申請，但是可以30天內appeal, 表格是I290B.

請問：

1.我應該直接再申請一次h1b還是該用I290B? 我能再申請h1b嗎？
- If you don't care the 2nd filing fee, you may refile an H-1 when your existing H-1 does not expire

2.I290B上麵有appeal和motion兩個選項， 請問兩者區別是什麽？哪種更好？
- Motion. Appeal is "上訴", which is not your option. When you select it, you lose the case for sure.

3.Motion下麵有reopen和reconsider兩種， 請問哪個更好？
- Reopen. "Reconsider" applied to your existing documents in USCIS' hands, but you need to submit new evidence.

4.由於我是485pending, h1b extension已經fail, 現在我是不是已經是AOS狀態了？
- Not necessary in AOS if your existing H-1 does not expire

那麽這樣是不是隻能用EAD， 即使重新申請到h1b也沒有用？
- Your H-1 extension will put you back to H-1, if you ever used AP/EAD.

如果不能工作， 等待期間我應該選擇帶薪休假還是停薪休假？
