Xiaobaidu, please help...How can I sue USCIS?

My I-140 RFE letter hasn't been received yet for 4 months. My attorney and my employer both wrote letters to USCIS and called USCIS numerous times for this missing RFE letter but there is no response so far. I cannot wait any longer and want to sue the USCIS for its poor service. How can I sue the USCIS?
