Thanks for the reply. His employer also suggested taking long leave of absence without pay could avoid laying off. Can H1-B take leave of absence without pay and still keep legal H1-B status (if the company do not report to CIS) ? Thank you very much.

My hu*****and and I are both H-1B, We filed 485 with HIM AS DEPENDENT and we have got receipt notice yet. He is losing his job. To keep legal status, can he apply for H4 now ? Will that invalidate his 485 application ? Is there any other options to keep his legal status ? Thanks a lot.
