1. If i file 485 this time (July, 2007) without j2 waiver notice, then
--better to submit after got waiver.

a . 2-3 months later, submit the j2 waiver notice;
--possible, but it is not easy to put it into your 486 folder, very easy lost the document.

b. or in Oct. 2007, when VB is March 2006, withdraw 485 filed in July, 2007, and file a new 485 based on teh same I-140(LC).
--not good idea

The above 2 options are ok?


2. I am H1 holder(3 year left), if 485 is denied, I will be out of status and have to immediately leave the USA? It seems that I should be still H1 holder if 485 is denied ?
--if you do not enter AOS (use EAD/AP), you are H1 status, no problem if 485 is denied.
