Please Help - H1-B Renewal After 6 Years

My H-1B will pass its alloted 6 year period and I need to extend it soon. Since my I-140 was approved and the I-485 is still pending, my lawyer told me that my H-1B will not be qualified for a 3-year extension.

I had thought the new H-1B will be good for 3 years since my -140 was approved. However, per my lawyer, due to the fact that my 485 is pending, I can not renew the H-1B for 3 years. Could anyone please help verify if my lawyer's view is correct. Thanks a lot.
