XiaoBaiTu and others, can Singaporean H1B1 holder file I-485?

My hu*****and is holding a Singaporean H1B1 since March 2007 and it'll expire on May 2008. My I-485 is pending and I-140 was approved on Sep, 2005. I knew that he couldn't file his own employment based immigration visa due to his special H1B1. I wonder whether he can join to file his I-485 as my spouse. Anybody know it please reply me.

My hu*****and wants to keep his non-immigration status too. He ted his regular H1B application on April 2 this year to try to get a three-year regular H1B which allowing dual intents. But he lost lottery. Now he is preparing his O1 application. He needs one more month to prepare O1 documents. I cannot wait. Do you think he can transfer his h1B1 to O1 after he files I-485?
