Sorry, I just found I made a typo in my first post. My hu*****and's Singaporean H1B1 is still available till May 2008 (instead of May 2007). So do you still think he can join to file his I485 as my spouse now and transfer his Singaporean H1B1 to O1 after he files I-485? Thanks.
His Singaporean H1B1 is only available for him for one year and two months. He ted his regular H1B application on April 2 this yaer to try to get a three-year regular H1B. But he lost lottery. So he is also want to keep his non-immigration status with O1.
