the petitioner's I-140 is assumed as approved already or approva

For I-140 and I-485 concurrent application, the USCIS will process the I-140 first. If you meet the basic NIW requirement, then they will look at your I-485 application (or if you do not meet the NIW requirement, they will reject the I-140 and I-485 together).

So when USCIS processes your I-485, the petitioner's I-140 is assumed as approved already or is approvable, that is why you can pick the box a, and you hu*****anb can pick the box b (otherwise, both of your I-140/I-485 are dinied already).
