Your lawyer is fooling you

1) since your old 140 was approved, you can carry over the old PD, ie, despite your current 140 has not been approved yet, you can file 485 now because Visa Availability is current for your PD.

2) there is no so called "有批準的 140不會使485加快". In order to approve 485, the underlying 140 has to be approved, otherwise, 485 approval has to wait till 140 is adjudicated. However, a pending 140 can't block filing 485 if VB is current.
