XiaoBaiTu,

I have H-1B and AP now. My hu*****and is working in Canada. I need to visit him every week. I always carpool with some friends.

My company lawyer asked me to use AP instead of H-1B. I heard it could take several hours in the border office if using AP. Before I got AP, I always use H-1B under 30-day contigent rule. My lawyer said as I don't have H-1B visa in my passport, I should use AP and EAD.

I really want to continue to use H-1B so I don't need to go inside the border office. I also prefer to use H-1B instead of EAD as my I-485 is pending. Is this ok?

My I-140 was approved.

Please advise.
