J1->H1b, I-485 pending, $5000 tax treaty?

I changed my status from J1 (student, academic training period) to H1b and filed I-485 in 2006. Can I still claim the $5000 China-US tax treaty? if
so, will it affect my I-485 application? I did not apply AP and EAD.
