Can I file a suit against the "attorney" ? a lot of thanks. Wait

I filed E(B)(2) for outstanding professor and paid for fast processing. just received denial letter. very frustrated~~

The reason the USCIS gave is as following:

"Title8, Code of Federal Regulations, Part 204.5(i)(1) describes who may file:

Any United States employee desiring and intending to employ a utstanding in an academic field uprofessor or researcher who is of the Act may file an I-140 visa petition for such classification.

There is no provisions for self-petitioning under this classification. A reiew of the record demonstrates that the petition was signed by XX(me), and marked as a "self" petition. As the beneficiary is ineligible to self-petition,the filing may be approved."


According to the reason above, it seems that I am ineligible to petition E(b)(2) by myself. But my "attorney" told me to self-petition it.

This attorney is not a real attorney. She is an employee of the international office in my university. She has no experience about the immigeation process, but I was required to file through her. I can't hire an attorney outside the university.This guy is not professional at all and she made a mistake in filing my labor certificate for E(b)(3).

I got very angry and want to kill her! Anyone can give me some advice? Thanks!
