Yeah, that is what I want to do. Fight to the end.

My H1B has been transfered to the new company, and the new comany has been paying me ever since the merged happened in 01/2005, 2 years ago.

Just do not understand why USCIS thinks that the merge is not lawful, they approved my H1B transfer to the new company, right?
