My old company applied the LC for me in 07/2003, then the old company merged to a new company. Now the new company filed the 140 for me with the old company on my LC. USCIS denied my 140 petition saying the merge does not legally transfer all the immigration responsibility from the old company to new company.

I filed 140 in PP, paying $1000 more. First, got RFE for company merge, we replied, got denied, filed appeal, got denied again. Now USCIS told me that the case has been sent to AAO.

If AAO maintains the original decision, then I will hire a lawyer to go to Federal Court.

So if I lose the case in Federal Court, I have to leave US immediately ? I am in my 9th H1B now, applying for 10th year H1B extension.

As long as my case does not get denied in the final Federal Court, I should be able to get H1B extension.

I also have EAD and AP now, but I do not want to use it.
