re-file PERM or EB1b, not appeal, take long time

Appeal will take 6 to 10 month so you don't have enough time for that. Try:
1. PERM - one month for adviterising, within 2 weeks, it will be approved (if in Chicago center). Then file I140 premium processing and it will be approved in 2 weeks. Then file premium processing H1b extension for 3 years. You have enough time for this. Find a good lawyer!
2. File another Eb1 A or B with 485. It could go faster if goes to TSC. You can apply EAD at the same time and use it when your H1B expired.
You can try both at the same time. Good luck!
