I have the similiar case and asked a lawyer about this yesterday. She checked with INS and said such casese are not subjected to H1b cap. I called INS by myself this morning and got the same answer. If you don't mind being put on hold for >20 min, you can double check with USCIS by calling the 1-800 customer service #. I'd really appreciate it if you can post the answer here cause I'm still worrying if the representative gave me the correct answer.
