You should have ted your H-4 application

with H-1 application. Your F-2 was not valid when H-1 was apporved. Theoretically, you are out of status as F-1 was no longer exist. You laywer mislead you completely.

The above comments are based on the fact that H-1 is starting now. If it starts in Jan. 2007 (i.e. F-1 is still valid till Jan. 2007), you need to change your F-2 to H-4 asap (you are not out of status yet).

H-4 application may need 3 months to get approved.
