1) If currently, I am in OPT, and file NIW 140, and then my status becomes H1B during the waiting period, does it count as a legal status though I change my status from OPT to H1B?

2) About work in the same area, what if I transfer from one company to the other company, and my work is changing from some research topics to other topics, but they all belong to one research field. In this case, does it qualify the requirement of working in the same area?
