You must be recommended a waiver by by DOS, approval of waiver by BCIS is not required if you change status to H-1b withing the US. The law is crystal clear, no room for reasoning. The rumor that waiver is only required for greancard purposes is nothing but a rumor. I bet you'll be screwed if you believe it.
