Yes, the appeal is for 140, but the 485 is dependent on 140. When I appeal, there is no final decision for my 140, so the 485 is not denied. So during the appeal process, both 140 and 485 are pending. This is my understanding. In my I-140 denial letter,USCIS said, "if no appeal is filed within the time allowed (30 days), this decision (denial) is final".

So if I choose to appeal within the 30 days, this decision is not the final. I can take my 140 and my 485 as pending. Thanks.
