1. Should we file H4 application to keep my spouse’s stay legally?
-- if your spouse have filed I-485, lost H1, will enter AOS, so you do not need worry. If not, you need filed I-485 following your NIW I-140 or H4, to keep stay legally.

2. I am working at the same university with almost identical job duty. Can I substitute the labor certificate? How much should we pay the same lawyer for LC substitute?
-- some company do this, to ask an university to do this is to hard, this is not legally way.

3. Since the LC has PD one yr earlier than my NIW, we would like to do LC substitute to get a earlier PD. Is it worthy since we have to pay lawyer another unknown $$$$$?
-- to keep LC PD, you have to got LC and get LC I-140 approved.
