請教小白兔-10 yeard hardship

we are living in US for 10 years legally, F1 and H1, green card application is still pending.

1. are we eligible for 10 year hardship green card since we have a child born in US?

2. Does the petioner have to be illegal before applying?

3. is this a right way to go?

4. where to find the policy or related info?
