My J1 will expire on 9/30, I already got J1 waiver.

The University said they need more than 3 months to prepare for my H1B application and can not before 10/30 which is last day I can stay in USA if I don't have valid status. They also don't let me hire lawyer to apply H1B for me.

My question are:
1. Can I application for H4 (my wife has H1B) before 10/30, and then H1B after 10/30?
2. If H1B gets approve before H-4 gets approve, can I cancel H4 application and how to cancel it?
