it depends on whether he/she is inspected by the border

when he/she enters USA. If he/she was inspected by the border, but later fell out of status, he/she can adjust status immediately by marrying a US citizen.

if he/she is never inspected by the border, he/she cannot get green card even by marrying ca itizen.
