I think that it's not enough to keep your status with

a H1B pending because the H1B period isn't current,if you hold other kind of visa,such as F1,should be ok,due to its grace period is 60 days.You may choose to leave for vacatin,or file another application of I-539,then cancel it after you getting new H1b approval.
