Help needed - PERM

Hi,

I filed traditional Labor in 2004 and now my application is in one of the backlog reduction centers. My employer said it's not qualified for filing PERM. My hu*****and is working for the same company as me but hasn't filed labor application. His H1-B will expire in 2009 and I wonder if we should find a lawyer ourselves and file PERM for my hu*****and?

Anybody has any idea?
