485 could only be filed after 140 approval?

I am preparing EB-1b I140, with current bulletin, I may have the chance to file 140 and 485 concurrently. But I also heard there is debate in the congress that 485 could only be filed after 140 is approved. Anybody has any idea when this policy would be issued?
