To my understanding, you can work either with H1 or EAD but not both. Even if you lost your job (lost H1) and have no EAD, you are still not Out of Status. You are in the status called AOS (adjustment of status), though you should find another job as soos as possible. Actually I believe you can have your GC in 2 years, before your H1 expired.

Why not simply renew your EAD, it's just 120$ to make you feel better and you can do it by yourself.
