I plan to Sue FBI and USCIS

Name check pending for three years, now searching for a lawyer for a mandamus case. Everything else is ready. Communicated with USCIS and they told me specifically that my name check is pending. Once it is clearly, they will approve my case. But I am so fed up with them and decide to sue. How much change for me to win? 485 pending for three years, EB1 OR filed at CSC.
