Am I a resident or non-resi. for tax purpose?

NIW140 已經批準, 485在排隊. 到美國已經超過6年, 現在是H-1簽證. 納稅/退稅時算resident嗎? 可以申請EIC (Earned Income Credit)嗎?
好像在哪裏看到/聽到過-- 在美國待到5年以上, 納稅時就和resident一樣, 不再填1040NR而是直接填1040. 那退稅/申請credit是不是也和resident一樣呢?
