You can.But you need do it asap,because the Congress may discuss to amend the law recently,after that,if your employer can't file I-140 for you in 45 days since
the approval of LC ,LC will be revoked.
BTW,you can't get a 3 years H1B if your situation like
above,only may renew H1B annually.
