If you can not ask your current company to employ you again and to issue you a fresh paycheck , I agree with your lawyer. The longer you stay here, the worse it is. A new H1 instead of EOS or EOS usually only check your new employer and won't check your status GAP. Keep your records (pay stub, pink slip, if any), in case. Do not worry too much, you have not trigger 3-year ban.
