That lawyer is stupid. Go ahead to get that job. You are perfect to get H1-B on Oct,1. After your OPT expire at the end of August, you have 2 month grace period to change your status. You only have one month gap. However, at the time you need to take vacation for one month. You need to ask your company's permission.
