new i140 after denial

My i140 NIW was denid at TSC, my attony did worse job, he knew nothing about RFE, just wrote a rebattal letter back without adding new reference letter, he is a mony chaser.

My question is whether I am eligible for a new i140 application, should I mention in the new application that I was ever denied? Does anyone got approved after denial. Thank you
