Some questions about change job during 485 pending

Dear Daxia,

I have the following questions regarding my I-485 pending. I filed my EB-1 (OR) I-140/I-485 concurrently. The I-140 has bee approved, and I-485 has been pending more than 180 days.I just got a new offer from other comapny. I know I can change my job during the I-485 pending even if my EB-1b is employer-sponsored, but

(1). I am using H-1B to work for my current employer, but I want to use AP to return China for a vacation. Is there an unemployment gap allowed for transferring my H-1B between my current and he next employers (e.g. several weeks).


(2). I already have my EAD. If I can not transfer H-1B, can I just use EAD to work after I returned from China even if there has some unemployment gaps between my old job and new job?
