AOS is a status. After you file 485, if your current non-immigrant status gets expired/denied(using ead, h1 expires,TN expires,blah blah...), you are on AOS NO MATTER you use your EAD or not. That's the risk you mentioned, but you need to face it. As I said, apply ead asap, have in on hand IN CASE you need it. Try best to renew your h1 at the same time.
