I am not sure if your lawyer is right or not. I believe you can apply H status after you filed I-140/I-485 with F-1 status. I am not sure if you will get into trouble if your I-485 got denied while you are still in F-1. The only good solution is to transfer to H status ASAP before you got any action from CIS regarding I-140/485
