H1-B while 140/485 pending

140/485 concurrent filed late Sep. 140 has been approved in Oct. My wife is F-1 and is graduating in Dec. this year. She wants to apply for H1-B now but it's not likely she will get it before March 2006. My question is what's her status between Dec. 2005 and March 2006?

I guess her legal status is probably not a problem since our 140 has been approved. However, we'd prefer not do anything that might compromise our non-immigrant visa status (H1, F1)
