apply for a new PERM ASAP

I am in a similar situation except that I still have 5 years left on my H1. I have a new PERM to be submitted in additon to the old RIR at Philly BPC. It is fairly fast for PERM and I140 to go through nowadays. As long as your I140 is approved, you can extend your H1 for 3-year periods indefinitely, until you finally get your GC. In the unfortunate event that your PERM does not go through smoothly, you can still extend your H1 based on the old LC application in BPC. So you don't lose anything. Good luck.
