To qualify H1 beyond 6-year on the basis of 104(c), I-140 approval is a must. But no need for filed > 365 days. 104(c) allows 3-year increment.

To qualify on the basis of 106(a), LC/I-140 pending > 365 days is a must. Either approved or pending is fine.
106(a) allows only 1-year increment.
