For your NIW case,
1. When I-140 is not approved: as long as your I-140 pending more than 365 days, you can extend H1 beyond 6-year limit by 1-year increment.
2. After I-140 is approved and if PD not current. You can extend H1 by 3-year increment. This condition does not require I-140 filed > 365 days ago.
