under J1 and file I485 after the waiver. His wife worked under EAD based on J2 and then GC, never changed her visa status before getting a GC.

I 140 doesn't have any restrictions. Some RNs will apply for I140 even before they step on the land of U.S., as long as there is a hospital to sponsor their GC petitions. In another word, you can file I140 any time, any where,as long as you are qualified for one certain GC petition category.
