That is my hunch too. Those American lawyers haven't been such situation before, and I believe the surrent solution they offer is solely based on their experience.

Can you let me know more about this issue: regarding
H1 from noncap to Cap transfer, is it same as Cap-to-Cap? Any document saying that?

My initial thought is that the compnay will file a new H1 for me. But even filing a new H1 needs all my past immigration documentation, including my current H1 renewal receipt. Does a new H1 petition also need H1 renewal approval?
